Cost estimate for proceedings
What civil proceedings in Belgium cost (registration fee, contribution to the Fund, bailiff) and what the losing party may have to pay back, with the procedural indemnity. Every amount with its legal basis and the date it is known as of.
A registration fee per case since 1 February 2019 (Law of 14 October 2018). The 2015 fees per party and per bracket of the claim were annulled by the Constitutional Court (judgment 13/2017). Check the current amounts at FPS Finance.
The judge sets the procedural indemnity between the minimum and the maximum (art. 1022 Judicial Code). It compensates lawyer’s fees: a party without a lawyer gets none. Several parties entitled to it: together at most twice the maximum; against a losing party with second-line legal aid, as a rule the minimum.
Not included: your own lawyer’s fees, an expert, translations, a copy of the judgment and enforcement.
